Regardless of the parties’ profile, filing a divorce case in Dubai starts with the registration of the case by either party which can be done on their own or through a Divorce lawyer, at the Family Guidance Section in the Emirate of residency. This stage is a mandatory procedure where a court appointed Conciliator will try to reconcile the parties and allow each party to raise their concerns without the presence of legal representatives. This phase can conclude to either amicable divorce - where an agreement is drafted with mutual understanding of both parties or to proceed before the Court of First Instance. In the Court of First Instance, a legal representation is not a requirement, however, it is always better and more reassuring to have one who has the expertise to represent you in front of the Jury. This procedure can go back and forth with defenses and counter-replies until the Judge comes up with a judgment. From here, a 28-day time period is given to move the case to the Appeal Court and another 28-day from the appeal judgment to move to the Cassation Court if needed.
The Execution Court follows after any of the court’s judgment, wherever the case is finalized, to act on the verdict issued.
